Access and Account

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province or jurisdiction of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment and shipping information.

Orders

When you place an order through TRAKVERO, you are making an offer to purchase the products contained in your order.

TRAKVERO reserves the right to accept or decline an order where permitted by applicable law.

Your order is not considered accepted until we confirm acceptance and successfully process payment.

Please review your order carefully before submitting it. Once an order has entered processing or fulfillment, we may be unable to accommodate cancellation or modification requests.

If we need to change, cancel or decline an order, we will attempt to contact you using the email address, billing information or other contact information provided when the order was placed.

You represent that products purchased through our store are intended primarily for personal or household use and not for unauthorized commercial resale.

Prices and Billing

Prices, discounts and promotions may change without notice.

The price charged for a product will be the price displayed at the time the order is placed, subject to any applicable discounts, taxes or charges shown during checkout.

Any applicable taxes and shipping charges, if any, will be displayed at checkout before you complete payment.

For qualifying United States orders fulfilled using our DDP (Delivered Duty Paid) shipping service, customers will not be required to pay additional import duties, customs clearance charges or import taxes upon delivery.

For destinations outside the United States, customs duties, import taxes, brokerage fees or similar charges may apply depending on the destination, shipping method and applicable laws. Where such charges are not expressly included in the shipping service or stated as DDP, they may be the responsibility of the recipient.

Prices displayed through TRAKVERO may differ from prices available through third parties.

We may offer promotions, discounts or special offers from time to time. Additional terms may apply to those promotions.

You agree to provide current, complete and accurate purchase, payment and account information for all transactions made through our store.

You agree to promptly update relevant information when necessary so that we can process transactions and contact you regarding your order.

You represent and warrant that:

• The payment information you provide is accurate and complete.
• You are authorized to use the payment method provided.
• Charges incurred through your authorized payment method will be honored by the relevant financial institution.
• You will pay the amounts displayed and agreed to at checkout.

Shipping and Delivery

TRAKVERO uses third-party fulfillment providers and shipping carriers to deliver customer orders.

For standard orders shipped to the United States, our current estimated delivery time is approximately 7–14 business days.

Delivery times are estimates only and are not guaranteed.

Processing, transportation and delivery times may be affected by factors including carrier delays, weather, customs processing, holidays, incorrect customer information, remote delivery locations and circumstances outside our reasonable control.

We will provide tracking information when available so customers can monitor the progress of their shipments.

Customers are responsible for providing a complete and accurate delivery address. TRAKVERO is not responsible for delays or failed delivery resulting from incorrect or incomplete information provided by the customer.

Unless applicable law provides otherwise, responsibility for loss or damage during shipment will be handled in accordance with our shipping carrier, fulfillment provider and applicable customer-protection requirements.

Intellectual Property

Our Services, including but not limited to trademarks, brand names, text, displays, images, graphics, product content, reviews, video, audio and the design, selection and arrangement thereof, are owned by or licensed to Growthonics LLC, TRAKVERO, our affiliates or licensors and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only.

You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit substantial portions of material from the Services without our prior written permission, except where permitted by applicable law.

Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright or other intellectual property belonging to TRAKVERO, Growthonics LLC, Shopify or any third party.

Unauthorized use of the Services may violate intellectual property laws.

TRAKVERO's brand name, logos, product names, service names, designs and slogans are trademarks or brand assets of Growthonics LLC or its licensors and may not be used without prior written permission where such permission is legally required.

Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify.

All other names, logos, product names and trademarks belong to their respective owners.

Optional Tools

You may be provided with access to tools or services offered by third parties as part of the Services.

We may not monitor or control these third-party tools.

You acknowledge and agree that access to such tools may be provided "as is" and "as available" without warranties, representations or conditions of any kind, except where required by applicable law.

We shall not be responsible for losses arising solely from your use of optional third-party tools where liability may lawfully be excluded.

Any use by you of optional tools offered through the site is at your discretion, and you should review the terms and privacy practices of the relevant third-party provider.

We may introduce additional features, services, tools or resources in the future. Such features will also be considered part of the Services and subject to these Terms of Service where applicable.

Third-Party Links

The Services may contain materials, integrations or hyperlinks to websites operated by third parties.

We are not responsible for independently examining or guaranteeing the content, accuracy or practices of third-party websites.

If you leave the TRAKVERO website to access third-party materials or websites, you do so subject to the terms and policies of those third parties.

We are not responsible for harm or damages caused directly by your purchase or use of products, services, resources or content provided independently by third parties, except where applicable law provides otherwise.

Please review the relevant third party's policies and practices before engaging in a transaction.

Questions or complaints concerning a third-party service should generally be directed to that provider.

Relationship with Shopify

TRAKVERO is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make through our store are made directly with TRAKVERO, operated by Growthonics LLC.

By using the Services, you acknowledge that Shopify is not the seller of the TRAKVERO products you purchase and is not responsible for fulfilling our obligations as the merchant.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, damages or liabilities arising from purchases made directly from TRAKVERO.

If you submit, upload, post, email or otherwise provide ideas, suggestions, feedback, reviews, proposals or other content relating to TRAKVERO ("Feedback"), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, distribute and display that Feedback for purposes connected with operating, improving and promoting our Services, subject to applicable law.

We may suspend or terminate access to the Services where permitted by law if you materially violate these Terms, engage in fraudulent or unlawful conduct, interfere with the operation or security of the Services, or create substantial risk to TRAKVERO, Growthonics LLC, Shopify or other users.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GROWTHONICS LLC, TRAKVERO, OUR AFFILIATES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THEM.

THIS MAY INCLUDE, WHERE PERMITTED BY LAW, LOSS OF PROFITS, REVENUE, SAVINGS, DATA OR OTHER CONSEQUENTIAL LOSSES.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability where applicable consumer protection law prohibits such limitation.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Growthonics LLC, TRAKVERO, Shopify and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from third-party claims, liabilities, damages, losses and reasonable legal expenses resulting directly from:

• Your unlawful use of the Services.
• Your violation of the rights of another person.

We will provide reasonable notice of an indemnifiable claim where practicable.

Nothing in this section limits rights or protections that cannot legally be waived.

Severability

Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent where such restriction is permitted by applicable law.

Growthonics LLC may transfer or assign these Terms and associated rights and obligations as part of a merger, acquisition, corporate restructuring, sale of assets or similar business transaction, subject to applicable law.

Governing Law

These Terms of Service and any separate agreements through which Growthonics LLC provides the Services will be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

Subject to applicable law, disputes relating to these Terms may be brought before the appropriate state or federal courts located in the State of Wyoming.

Nothing in this section limits any mandatory consumer protection rights or jurisdictional protections that apply to you under applicable law.

The headings used in these Terms are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

Changes to Terms of Service
